1. Acceptance of terms
By downloading, installing, or using the Nestori app (the "App"), you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the App.

2. Service description
Nestori is a mobile and web app that lets you:
- Save digital memories (photos, videos, voice notes, letters, milestones) about your child.
- Track pregnancy weeks, symptoms, movements.
- Invite family members to contribute their own memories.
- Deliver the memories to your child at age 18 (or earlier milestone ages you choose).
3. Eligibility and account
- You must be at least 18 years old to create an account.
- You must be a parent or legal guardian of the child whose data you save.
- You are responsible for keeping your credentials safe. All activity on your account is presumed to be yours.
- One account per person. Multiple accounts may be suspended.
4. Content ownership
You own the content you upload (photos, videos, text, audio).
By uploading content, you grant us a limited, non-exclusive, royalty-free license strictly to:
- Store and display the content in the App for you and the people you invite.
- Process media (compression, thumbnail generation, face detection via Amazon Rekognition, audio transcription via OpenAI Whisper if enabled).
- Deliver the memories to your child at the chosen age.
We claim no ownership over your content. We do not use it for marketing, AI training, or resale to third parties.
5. Acceptable use
You agree NOT to:
- Upload illegal, defamatory, abusive content, or content that infringes others' rights.
- Upload sexually explicit content, gratuitous violence, child sexual abuse material.
- Use the App for harassment, spam, fraud.
- Attempt to access other users' accounts without permission.
- Reverse-engineer, decompile, or otherwise tamper with the App.
- Use the App to collect data about minors if you are not their parent/legal guardian.
Violating these rules may result in immediate account suspension without refund, reporting to authorities (illegal content), and civil damages claims.
6. Family invitations
When you invite a family member (grandparent, godparent, friend):
- You remain responsible for content they contribute.
- You have full control: you can revoke access any time and moderate their content.
- We don't share their personal data with other users without their consent.
7. Subscriptions and payments
7.1. Plans
- Free plan โ limited (max 10 memories, 0.5 GB storage).
- Nestori 18 โ 1 child, 2 family members, option to add extra child for $1/month.
- Nestori Family โ unlimited children, unlimited family members.
Current pricing and full details are shown in the App. We reserve the right to change prices with at least 30 days' notice.
7.2. Trial period
We offer a 30-day free trial on first subscription. If you don't cancel before the trial ends, billing activates automatically.
7.3. Auto-renewal
Subscriptions renew automatically at the end of each period. You can cancel any time:
- iOS: Settings โ [your name] โ Subscriptions โ Nestori.
- Android: Google Play โ Menu โ Subscriptions.
- Web: Profile โ Stripe billing portal.
Cancellation takes effect at the end of the current paid period.
7.4. Refunds
- iOS/Android: refunds are handled by Apple/Google per their policies.
- Stripe (web): we offer a full refund within the first 14 days, per EU distance-selling law. After 14 days, refunds are considered only for critical technical issues.
- Send refund requests to support@nestori.io.
7.5. What happens if you stop paying
- Your account reverts to the Free plan automatically.
- Existing memories remain accessible, BUT you cannot add new ones beyond the Free plan limit.
- We keep your data for 90 days, then notify you that you should export it.
- We never delete data without warning.
8. Time capsule (delivery at 18)
- Memories marked as "time capsule" or "parent message" open only at the age you set (5, 10, 13, 16, or 18).
- We commit to reasonable best efforts to deliver memories, but do not guarantee perpetual continuity of the service (e.g. if the company ceases operations in 15 years).
- For safety, we recommend periodically exporting content (Profile โ Export Data) and keeping a copy offline.
- If we discontinue the service, we'll notify you at least 180 days in advance and provide a full export.
9. Account suspension and deletion
You can delete your account any time from Profile โ Delete Account. After 30 days (recovery window), data is irreversibly deleted.
We may suspend or delete your account if:
- You violate these Terms (Section 5).
- Your account is inactive for more than 24 months on the Free plan (we notify 30 days in advance).
- We detect fraud or abusive usage.
10. Limitation of liability
To the maximum extent permitted by law:
- The App is provided "as is", without implied warranties of fitness for a particular purpose.
- We are not liable for data loss caused by device failure, cyberattacks, or force majeure.
- Our total cumulative liability is limited to the amount you paid us in the last 12 months.
This limitation does not affect your statutory consumer rights under applicable law.
11. Changes to these Terms
We may update the Terms periodically. Material changes are announced via email and in-app at least 30 days in advance. Continued use after the effective date constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by Romanian law. Any dispute will be resolved by the competent courts in [CITY โ e.g. Bucharest].
Before going to court, we encourage amicable resolution via support@nestori.io. Consumers may also turn to ANPC (Romanian Consumer Protection) or the EU ODR platform.
